Legal

This page describes, in plain language, what As'Vaye actually collects and how the platform actually works today. It has not yet been reviewed by legal counsel and should not be treated as a final, binding legal document until that review is complete.

Privacy Policy

As'Vaye collects only the information it needs to run your trip safely, and nothing more.

What we collect

  • Account details: your name, phone number, and email address.
  • Trip data: pickup and drop-off points, routes, fares, and booking history.
  • Live location: only while you're on an active trip, used to power live tracking, trip sharing, and deviation alerts. We don't track your location outside of a trip.
  • For drivers: your driver's licence number, kept in a separate, encrypted table that no one — not even our own staff querying the main database — can read in plain text. Your vehicle's registration, make, and model.
  • Payment and payout details, once digital payments go live — held only by our payment providers, not stored on our own servers as raw card or bank details.

Why we collect it

To connect you with a driver or passenger and run the trip: matching, dispatch, fare calculation, and the OTP handshake that starts a trip.

To keep you safe: live trip tracking, the trip-share link, deviation alerts, and the panic button all depend on knowing where an active trip is.

To know who's driving: every driver submits their licence and vehicle details before they can accept a trip. For drivers on a private fleet, the fleet owner carries out vetting against the guidelines we require them to follow — see the Driver Agreement below.

To meet our own legal and regulatory obligations, including under South African transport regulation and POPIA itself.

How we protect it

Every table in our database enforces row-level access control by default — a passenger can only ever see their own bookings and the driver on their current trip, never anyone else's data.

Identity documents (driver's licence numbers) are never stored in plain text. They live in an isolated, encrypted table, and the encryption key itself is never present in our application code — only a narrowly scoped database function can use it, and it never returns the decrypted value to anyone.

We don't sell your information. We share it only with the other party on your trip (name, vehicle, and photo — the same as any ride you'd take in person), with the service providers we rely on to run the platform (under confidentiality obligations), and when we're legally required to.

Your rights under POPIA

  • Ask us what personal information we hold about you.
  • Ask us to correct information that's wrong or out of date.
  • Ask us to delete your information, or object to how it's being used, subject to what we're legally required to keep (for example, trip records needed for dispute resolution or regulatory compliance) — request this any time from the app's Profile screen, or at asvaye.co.za/delete-account without needing the app installed.
  • Lodge a complaint with South Africa's Information Regulator if you believe we've mishandled your information.

How long we keep it

We keep your account and trip data for as long as your account is active, and for a reasonable period after that where we're required to for dispute resolution, safety, or legal and regulatory reasons. Beyond that, it's deleted or anonymised.

Changes to this policy

If we make a material change to how we handle your information, we'll update this page and, where appropriate, let you know directly in the app.

Terms of Service

By creating an As'Vaye account, you agree to these terms. As'Vaye operates a technology platform that connects passengers with independent solo drivers and private fleet operators — we're not a taxi company, and drivers on the platform aren't our employees.

You must be at least 18 years old to book or drive on As'Vaye, and provide accurate information when you sign up. You're responsible for keeping your account credentials secure and for activity that happens under your account.

Booking and payment

You can pay a driver directly in cash, or, where a trip supports it, pay digitally through the app. Digital payments are held in escrow and released to the driver only once the trip actually starts — the same OTP handshake that starts your trip releases the funds.

Fares, fees, and payout terms are set out on our Pricing page, which forms part of these terms. Payment providers and exact figures are still being finalised with our banking partners and may change before they're final.

Conduct

Treat other people on the platform with respect. We can suspend or remove an account that puts someone else's safety at risk, is used fraudulently, or breaches these terms.

Liability

As'Vaye provides the technology that connects you with a driver or passenger; the trip itself is carried out by an independent driver or fleet operator, not by As'Vaye. To the extent permitted by South African law, our liability for anything arising from a trip is limited accordingly — this doesn't affect any right you have that can't be limited by contract.

Changes, termination, and governing law

You can close your account at any time. We can suspend or terminate an account for breach of these terms. We may update these terms from time to time; continuing to use As'Vaye after a change means you accept the updated terms. These terms are governed by the laws of South Africa.

Driver Agreement

This section applies to solo drivers and fleet-operator drivers using As'Vaye. You operate as an independent contractor, not an As'Vaye employee — you choose when and whether to drive.

Before you can drive

  • Your South African driver's licence number, which we store encrypted and never in plain text.
  • Your vehicle's registration number, make, model, and seating capacity.
  • You confirm that the licence and vehicle details you submit are genuine and belong to you — providing false information is a breach of this agreement.

If you drive for a private fleet

As'Vaye doesn't independently background-check or interview drivers before they accept their first trip — what we collect above is what you submit yourself. For a solo driver, that's a limitation you and your passengers are both accepting directly.

For a driver operating under a private fleet, the fleet owner is responsible for vetting you before adding you to their roster — not As'Vaye. We require every fleet owner to follow our driver-vetting guidelines before doing so:

  • Check the driver's licence in person against their ID, and confirm it's valid and not expired.
  • Confirm the vehicle they'll drive is roadworthy, properly insured, and genuinely registered to the fleet or the driver.
  • Where practical, request a police clearance certificate or equivalent background check before onboarding.
  • Keep a record of what was checked and when — As'Vaye may ask a fleet owner to produce this if a safety concern is raised about one of their drivers.

A fleet owner who adds a driver to their roster without following these guidelines is in breach of their own agreement with As'Vaye, independent of anything this driver does on a trip.

Commission and payouts

As'Vaye takes a flat platform fee on digital bookings, set out on our Pricing page. Cash trips aren't subject to this fee. Digital-booking funds are held in escrow for the duration of the trip and paid out to your bank account via EFT once the trip is marked complete, with no cut taken from your fare.

Your responsibilities

  • Keep your vehicle roadworthy and appropriately insured — As'Vaye doesn't provide vehicle insurance on your behalf.
  • Comply with South African road transport regulation applicable to your trips.
  • Treat passengers safely and respectfully; every trip is GPS-logged, and that record backs both sides in the event of a dispute.

Ending this agreement

You can stop driving on As'Vaye at any time. We can suspend or deactivate a driver account for failed verification, safety concerns, or breach of this agreement or the Terms of Service above.
